These Terms of Service, or Terms and Conditions of Use (the “Terms”, “Terms of Service”) and the attached payment plan (“Payment”) define the business relationship between you (“You”, “Contractor”, or “Student”) and BUILD YOURSELF ACADEMY LLC, with its headquarters in the City of Albuquerque, NM, United States, at 2201 MENAUL BLVD NE STE A (“Build Yourself Academy”, or “we”), with respect to the hiring of Build Yourself Academy online language learning (“Service(s)”, “Service Provision(s)”, “Course”, “Lesson(s)”). In addition, you are bound by the Privacy Policy, available at bys.academy.

By contracting Build Yourself Academy, you express your consent and agreement to the Terms. If you do not agree to the Terms of Service, do not use this Service.

1. Description of Services

All the Services described are provided by Build Yourself Academy while the contract is paid for and active, and sold exclusively on https://bys.academy, the company's website.

• Services Online English lessons for private students, pairs and groups. We work with hours/month. The minimum number of lessons (hours) contracted is 4 hours per month, and there is no maximum number of lessons contracted, which can be changed at any time. Contracted hours/lessons must be used up within the month of the contract.
• Initial Interview, Leveling and Introductory Class** Before deciding on lessons, we will conduct an initial interview (trial lesson) which can be arranged free of charge and without any obligations! This first meeting is an opportunity for the student to get to know the teacher, talk about their learning objectives and get to know a little about the methodology, the material used in the lessons and to visualize how the lessons will actually happen. A placement test is also carried out to determine the student's level and establish the initial goals of the course. At the end of the interview, the days and times of the classes are set, registration is closed and the student receives access passwords for the meetings and the student area.
• Methodology & class models** Classes are online, held by videoconference on the Teams platform or Google Meet at pre-scheduled times. We use the Teams for Education (Microsoft) and/or Classroom (Google) platforms as an LMS (Learning Management System) for the classes. We also have a student area for tracking payment, class times and days, class registration and future features. After the initial interview and defining the student's objectives, the student will be given access to the student area and to Teams and/or Classroom, where all the lesson material and activities will be shared according to their pedagogical needs.

2. Payment

Payment for lessons is made in advance, by the 25th (except for students enrolled before Nov 2023, who pay by the 10th of every month) and refers to the lessons taken the following month. Charges refer to the lessons (hours) contracted based on the hourly rate specified on the website at the time of contracting the service.

Charges will be sent by WhatsApp and also made available in the student area up to 5 days before the due date and will be subject to additional charges (2% fine + 0.033% per day) in the event of delay. Failure to pay the charge will result in the service (lessons) being canceled until payment is made. For credit card payments there is an extra charge of + 4%.

Absence from lessons does not cancel the lesson plan or the recurring charge.

3. Change of Teacher

The student may request a change of teacher upon timely request, respecting the rescheduling policy and according to the availability of the requested teacher's schedule.

Build Yourself Academy does not guarantee that the teacher will remain with the student for the duration of the course. If necessary, teachers will be swapped depending on the availability of classes and the schedules of both the student and the teacher.

If a teacher leaves the company, the company will offer a replacement teacher.
